This book symposium on Jason Holt’s Kinetic Beauty: The Philosophical Aesthetics of Sport includes commentaries from Stephen Mumford, John E. MacKinnon and Andrew Edgar with replies from Holt.

Recently a number of writers have argued that a new form of relativism involves a form of semantic context-dependence which helps it escape the perhaps most common objection to ordinary contextualism; that it cannot accommodate our intuitions about disagreement. I argue: (i) In order to evaluate this claim we have to pay closer attention to the nature of our intuitions about disagreement. (ii) We have different such intuitions concerning different questions: we have more stable disagreement intuitions about moral disputes than (...) about, say, disputes about matters of taste. (iii) The new form of relativism does not vindicate the stable intuitions about disagreement. (iv) It does a better job explaining the unstable intuitions than contextualism. But, pace some relativists, it is not clear that assertion-truth rather than just proposition-truth has to be relativized to accomplish this. (shrink)

This paper defends moral realism against Sharon Street’s “Darwinian Dilemma for Realist Theories of Value” (this journal, 2006). I argue by separation of cases: From the assumption that a certain normative claim is true, I argue that the first horn of the dilemma is tenable for realists. Then, from the assumption that the same normative claim is false, I argue that the second horn is tenable. Either way, then, the Darwinian dilemma does not add anything to realists’ epistemic worries.

The article defends a mild form of pessimism about moral deference, by arguing that deference is incompatible with authentic interaction, that is, acting in a way that communicates our own normative judgment. The point of such interaction is ultimately that it allows us to get to know and engage one another. This vindication of our intuitive resistance to moral deference is upheld, in a certain range of cases, against David Enoch’s recent objection to views that motivate pessimism by appealing to (...) moral autonomy or understanding. Enoch is right to point out that the value of autonomy or understanding cannot provide reason not to defer, if deferring would reduce the risk of treating others wrongly. But in the kind of case where we would want other people to act authentically towards us, even at the cost of a greater risk of wrongdoing, we should do the same towards them. (shrink)

A person, usually a child, enters civilization after having been raised by wolves or kept in some kind of cruel captivity. The outsider perspective on domestication ensuing in an edge of a culture's self-recognition of its clumsier attributes, what has been taken for granted becomes apparent, is brought to the foreground with the stranger and made questionable. Amusement follows naïve questions or observations such as Kaspar Hauser in the Herzog film, The Enigma of Kaspar Hauser, when Kaspar notes that while in his room he is engulfed by it, but when he looks at the tower he can turn away and it disappears. Ergo, the room is larger than the tower. How entertaining. The aberrant one destabilizes the comforting cultural normative. Places become seen as mere impressions out of space, a patterning, a rut that not everyone lives in like us. This is one figure of the feral. The naiveté that begs all the questions. As a figure for a certain philosophical disposition, the rapidity of one’s saccade scans the environment, intuits it’s space, not from an initial thaumazein or a Critchlean sense of disappointment, but from a child-like naiveté bent on survival. To serve the naïve is merely one form of critique, and it is not nearly used enough in lieu of the critique that provides answers. How dull. It is not necessary to be an outsider to entrench a critique with naiveté. After having forced to suffer in the most parched and rocky terror, itself for so long rooted upwards of fifty feet into the ground upon which it grows, even a grapevine can spontaneously produce a white grape on a red vine. The curious feral can arise from within, and like pinot grigio, it adds variety without admonishing its roots. There is also the feral dog. Not raised by wolves, but humans. Founded in place the figure of this feral denies this place. The trajectory of this feral roves from the cultivated to uncultivated, or in speaking of plants from controlled to volunteer, finding the necessary nutrients and survival patterns on its own. Finding other places, reaching out into space testing its fertility. And when introduced into a foreign environment, it withers or flourishes. We would like to attempt a thesis at this juncture and to accept neither feral figure in its entirety, but to argue for the intimate conjunction between a cultivated place and its resonance with the space it procures for its nest and kin. There is no para-academic. We all have day jobs. 'Para-academic' seeped through the cracks as an adjective in the call to frame publishing dedicated to the critical rigor expected by academic publishing, but to deny the limitations of guarded legitimation through capital means. Open-access holds hands with this parasitic descriptor. Para-academic publishing's refusal to adhere to the valuation of locked access of a site, the site “of a desperate initiation to the empty form of value,” 1 seeks to recognize not merely an inclusive interpretation of significance, but the significance of thinking practice. The practice inside the paywalls of academic 'education' is held in a deathgrip by its infatuation with value and information, both empty without the apprehension of human experience, the barbaric yawp. “I can't breathe in here.” It is not that a para-academic practice leads one to the childish wonder of Kaspar Hauser who wonders about the spatiality of his room. It is the academic legitimation that distorts that one can hold the understanding of both in a constellation of place and space. Led to believe there is only a place for things, we are led to disillusionment. It is also not that a para-academic practice relinquishes itself to the invasive growth outside of careful cultivation, an abandonment of pleasantries for the toothy growl of a predator. It is the academy's fear that thought does not require capital to signify value. Some of the most nutritious meals can be foraged. Defining a para-academic practice is not outlining a place of accreditation of the practice, it is the recognition that any place is subject to modulation by the space it inhabits as well as creates. The para-academic practice keeps an eye of the creation of spaces, follows those paths that eat themselves in the name of academia. This is not unlike Red Peter's report to the academy, only successful if we report in idle idiosyncratic banalities that we have once again become victorious in our acculturation and nullification within the confines of accredited mush and our trajectory of wild rigor is defeated in our desire for recognition as recognizable in this place. Weeds are integral to the functioning of a large ecosystem. The manicured garden is entirely reliant on its keeper. The pansy can also go wild once neglected, the daisy definitely does.... a universe comes into being when a space is severed or taken apart. The skin of a living organism cuts off an outside from an inside. So does the circumference of a circle in a plane. By tracing the way we represent such a severance, we can begin to reconstruct, with an accuracy and coverage that appear almost uncanny, the basic forms underlying linguistic, mathematical, physical, and biological science, and can begin to see how the familiar laws of our own experience follow from the original act of severance. To stay buoyed between a site of visible happening and haptic perspicacity. Bounded by one or the other leads to a desiccation of potential knowledge. The tumbleweed tumbles until met with mud, a bare structure moving but not movement. A tumbleweed tumbleweeds, propagates only at a place. It becomes significant again, continues. Significance, the site where meaning is made known through kinesthetic apprehension. 2 The feral founds a gestural horizon; an outsider’s scrawl-becoming-law; Deleuze teaching Meno’s dog geometry. Place as marked, outlined, recognized, territorialized. The academies marked by their peculiar disciplines, outlined by their rigid boundaries, recognized as factories of value. This far from ensures complete purchase on the space of thought, but it has made an undeniably elaborate means of making work significant. The academy is a muddy spot, it is fertile, but its gates are high and its dogs are barking. The coordinates of concept and experience. Already claimed by a stabilizing suspension, the terms enter specificity of ‘this is this’. Another correlation: activity and the individual. The individual, a placeholder in the crosshairs of juridical identification. Activity, what expands and surrounds this location, but utterly indebted to the node of “one who”. What's happening in this oscillation of nature and nurture is practice. Practice, as Stengers tells us “is not the activity of an individual or the product of that activity. It is the ingredient without which neither that activity nor this product would exist as such.” 3 Moving outward from our own honing, we're curious about the ingredient creating the place for holding conceptual and experiential engagements in each hand. And we'd like to argue that this place is not a limiting specification, but a practice undulating daily, by the minute. And we call this practice the para-academic practice. The academic can, and we argue should, be active para-academically, to escape the bounds, recognizing no site specific place as a place to rest on or the place to grab the Kafka's top and wonder at its disobedience not to continue. Yet, the para-academic practice must maintain the desire for rigor in scholarship. Indeed desiring past itself to claim a more naïve rigor, one that does not take its form for granted. Without a para-academic practice, the scholar spends half the time merely working on behalf of a hierarchy, to maintain it, and the other measly amounts of time are in the name of thinking, but only in name. Not to mention the amount of debt it takes to attend the halls of higher education. Not to mention the snoring tenures. Not to mention the barely scraping by adjuncts. Not to mention the materials that shake the very force of producible theory. Not to mention when swimming in texts becomes slogging through data. Academia is a barbaric food chain and it is our claim that there is, as always, an imperative for thought to move, with Heidegger, beyond the logics of calculation and planning, to a time of its own. The path, into the panic of the dark wood of this space can be followed by any; any who let the silence and the rigor enter the play. Holt's most direct and radical challenge to the educational status quo and a clarion call to parents to save their children from schools of all kinds.

The most basic argument for moral relativism is that different people are (fundamentally) disposed to apply moral terms, such as ‘morally right’ and ‘morally wrong’, and the corresponding concepts, to different (types of) acts. In this paper, I argue that the standard forms of moral relativism fail to account for certain instances of fundamental variation, namely, variation in metaethical intuitions, and I develop a form of relativism—pluralism—that does account for them. I identify two challenges that pluralism faces. To answer the (...) challenges, I first argue that, due to fundamental conceptual variations in ordinary descriptive (nonmoral) discourse, a form of pluralism holds there as well and that this pluralism can answer the corresponding challenges. I then argue that the answers transfer to moral discourse, since the phenomenon of moral variation is structurally identical to that of descriptive variation. (shrink)

While defining martial arts is not prerequisite to philosophizing about them, such a definition is desirable, helping us resolve disputes about the status of hard cases. At one extreme, Martínková and Parry argue that martial arts are distinguished from both close combat (as unsystematic) and combat sports (as competitive), and from warrior arts (as lethal) and martial paths (as spiritual). At the other extreme, mixed martial arts pundits and Bruce Lee speak of combat sports generally as martial arts. I argue (...) that the fine-grained taxonomy proposed by Martínková and Parry can be usefully supplemented by a broader definition, specifically the following: martial arts are systematic fighting styles and practices as ways of embodying wisdom. A possible difficulty here is that such views face the charge of overemphasizing the “philosophical” aspect of martial arts. My definition can, however, avoid this apparent problem. If martial arts essentially aim to embody wisdom, this applies no less to the (strategic) practical wisdom of The Art of War than to the (ethical) practical wisdom of the Tao Te Ching. In an extended sense, then, any systematic fighting style, including combat sports, may count as a martial art insofar as it embodies wisdom by improving practical fighting skills. (shrink)

According to doxastic normativism, part of what makes an attitude a belief rather than another type of attitude is that it is governed by a truth-norm. It has been objected that this view fails since there are true propositions such that if you believed them they would not be true, and thus the obligation to believe true propositions cannot hold for these. I argue that the solution for doxastic normativists is to find a norm that draws the right distinction between (...) those true propositions we are obliged to believe (“ordinary non-tricky propositions”) and those we are not (“tricky propositions”). I develop a norm which I argue does exactly this, and further argue that it can be used to salvage the idea that belief is constitutively normative. (shrink)

Abstract During the last decades it has become widely accepted that scientific observations are ?theory?laden?. Scientists ?see? the world with their theories or theoretical presuppositions. In the present paper it is argued that they ?see? with their scientific instruments as well, as the uses of scientific instruments is an important characteristic of modern natural science. It is further argued that Euclidean geometry is intimately linked to technology, and hence that it plays a fundamental part in the construction and operation of (...) scientific instruments. Finally, Euclidean geometry is compared to fractal geometry, and the question of its a priori status is raised. Although the position that Euclidean geometry is a priori in the original Kantian sense is untenable, the paper concludes that in some restricted sense Euclidean geometry may be said to be a priori. The book provides perspectives on what it means to be accountable and independent as a judge, the role of language and languages in the quest for justice, while other contributions acquaint readers with the some of the structures of courts themselves, or indeed question for whom judgments are written. ABSTRACTPolitical rituals, like the sovereign acclamation described in Rousseau’s social contract, exhibit a logic of representation that seem to oscillate between presence and absence, and enact a problematic identification of the people as a multitude of individuals and as a whole. This article explores this logic of rituals by comparing problems of political representation in Rousseau and Agamben with the highest principle of Aristotle’s philosophy. It thus elucidates the problem of representation in rituals of political power.

In Norway, research ethics committees in medicine are organized as interdisciplinary regional committees. Since 1999, Norway requires that one member of each ethics committee be a psychologist. Competence in psychology is considered relevant not only when evaluating psychology projects. As discussed in this article, a competence in psychology is also relevant for evaluating a number of issues common to all research involving human subjects as well as in the evaluation of protocols where other professionals have employed psychological methodologies.

Abstract This paper analyses the uses of the word ?nature? (in P?li pakati, Sanskrit prakrti) in the P?li scripture. In the P?li scripture pakati is never used as a concept of nature considered as a unity or an entity, or as a material cause, as in the S?mkhya and Yoga, but it describes acts which are considered natural, regular and usual. The article tries to answer three questions. 1. What is the meaning of the term pakati in the P?li scripture? (...) 2. What is the relation between the term pakati in the P?li scripture and the Sanskrit term prakrti in general and as a technical term in the S?mkhya and Yoga schools, in the Medical schools and in the Jain scriptures? 3. The principle of non-injury toward all living beings in India was originally a rule restraining human interaction with the natural environment. I compare two discourses on the relationship between humans and the natural environment in ancient India: the discourse of the priestly sacrificial cult and the discourse of the renunciants. In the sacrificial cult, all living beings were conceptualized as food. The renunciants opposed this conception and favored the ethics of non-injury toward all beings, which meant that no living being (...) should be food for another. The first represented an ethics modeled on the power that the eater has over the eaten while the second attempted to overturn this food chain ethics. The ethics of non-injury ascribed ultimate value to every individual living being. As a critique of the individualistic ethics of noninjury, a holistic ethics was developed that prescribed the unselfish performance of one’s duties for the sake of the functioning of the natural system. Vegetarianismbecame a popular adaptation of the ethics of non-injury. These dramatic changes in ethics in ancient India are suggestive for the possibility of dramatic changes in environmental ethics today. (shrink)

This article is concerned with the role of experientia in medieval law. This could take a number of forms, three of which are treated by way of example. In the first part of the essay, the author discusses how experience first came to serve as a source for the creation and legitimisation of new law since Late Antiquity. Henceforth, it became an important principle within Canon Law that served not only to create legal regulations supplementary to traditional law but also (...) to overwrite and replace it. The second part of the essay is concerned with the role of expert reports (consilia) by men learned in the ius commune which were requested to help rule cases under local law. Being dispersed in collections after their use in court, consilia made a significant impact on common and local law. In the final section the author discusses the use of expert witnesses (from areas as diverse as medicine, agriculture, the arts and crafts etc.). Expert opinions were recognised by court as high-value evidence. (shrink)

In a certain sense, uncertainty andignorance have been recognized in science andphilosophy from the time of the Greeks.However, the mathematical sciences have beendominated by the pursuit of certainty.Therefore, experiments under simplified andidealized conditions have been regarded as themost reliable source of knowledge. Normally,uncertainty could be ignored or controlled byapplying probability theory and statistics.Today, however, the situation is different.Uncertainty and ignorance have moved intofocus. In particular, the global character ofsome environmental problems has shown that theproblems cannot be disregarded. Therefore,scientists and technologists (...) have in many wayscome into a new situation. The Chernobylaccident is a dramatic example, however,problems such as a possible greenhouse effect,a possible reduction of the ozone layer, and soon are all of the same type. These encompasstotally different problems than scientists andtechnologists are traditionally trained to dealwith. In these cases, the standard use ofstatistics has to change, the burden of proofshould be reversed, one should draw ondifferent kinds of expertise, and, in general,science should be ``democratized.''. Motivational externalists and internalists of various sorts disagree about the circumstances under which it is conceptually possible to have moral opinions but lack moral motivation. Typically, the evidence referred to are intuitions about whether people in certain scenarios who lack moral motivation count as having moral opinions. People’s intuitions about such scenarios diverge, however. I argue that the nature of this diversity is such that, for each of the internalist and externalist theses, there is a strong prima facie reason to (...) reject it. That much might not be very controversial. But I argue further, that it also gives us a strong prima facie reason to reject all of these theses. This is possible since there is an overlooked alternative option to accepting any of them: moral motivation pluralism , the view that different internalist and externalist theses correctly accounts for different people’s concepts of moral opinions, respectively. I end the paper with a discussion of methodological issues relevant to the argument for moral motivation pluralism and of the consequences of this view for theories about the nature of moral opinions, such as cognitivism and non-cognitivism. Contrary to popular opinion, non-natural realism can explain both why normative properties supervene on descriptive properties, and why this pattern is analytic. The explanation proceeds by positing a subtle polysemy in normative predicates like “good”. Such predicates express slightly different senses when they are applied to particulars (like Florence Nightingale) and to kinds (like altruism). The former sense, “goodPAR”, can be defined in terms of the latter, “goodKIN”, as follows: x is goodPAR iff there is a kind K such that (...) x is a token of K, and K is goodKIN. Now if x and y are descriptively exactly similar, then they are tokens of exactly the same kinds, so x is a token of a goodKIN kind if and only if y is. Therefore, by the definition, x is goodPAR if and only if y is. Supervenience just falls out of the definition of “goodPAR”. (shrink)

A version of this paper was given as the Inaugural Steven Edwards Memorial Lecture at the 25th conference of the International Philosophy of Nursing Society 16th August 2022. Using the literary meaning of ‘whither’, that is ‘to what place’, this paper will explore the role of philosophy in nursing, past, present, and future. The paper will begin with some thoughts on the history of nursing philosophy, its development as a subject and the scholarly activities that have led to where it (...) sits today. The establishment of the journal Nursing Philosophy, the Annual Nursing Philosophy Conference, the International Philosophy of Nursing Society (IPONS) and their influence on nursing both in the academy and in practice will be discussed. The concept of nursing philosophy as a discipline will be considered, and how this fits with nursing theory, and nursing knowledge. Philosophical questions central to understanding contemporary nursing in a globalised world will be explored and the use of analytical philosophy and philosophical method in addressing such questions. The paper will conclude by looking to the future; what the role of philosophy might be in shaping nursing as a discipline and in the preparation of future practitioners. (shrink)
